Affiliate Terms & Conditions

These Affiliate Terms & Conditions ("Affiliate Terms") govern participation in the Go Girlfriend affiliate program (the "Program"), operated by First Kind AI Inc. ("we", "us", "our"). By applying to or participating in the Program, you ("Affiliate", "you") agree to these Affiliate Terms, our Terms & Conditions, our Acceptable Use Policy, and our Privacy Policy.

1. Eligibility

  • You must be at least 18 years old and able to enter a binding contract.
  • You must provide accurate registration and payment information and keep it current.
  • We may approve or decline any application, and may remove any Affiliate, at our discretion.

2. The Program

Once approved, you receive a unique tracking link or code. When a new customer signs up and subscribes through your valid tracking, you may earn a commission. Commission rates, attribution (cookie) windows, qualifying events, and any tiers are those stated in your affiliate dashboard or written affiliate agreement, which form part of these Affiliate Terms and may be updated on notice.

3. How to promote (and how not to)

You must promote Go Girlfriend honestly and lawfully, consistent with its nature as a platonic AI companion service for adults. You must:

  • Disclose your affiliate relationship clearly wherever you promote us, as required by the U.S. Federal Trade Commission (FTC) endorsement guidelines and any other advertising or consumer-protection rules that apply to you.
  • Only promote to adults (18+) and never to minors or audiences likely to be minors.
  • Make only accurate claims. Do not misrepresent the service, its pricing, or its features, and do not imply that companions are real people.

The following are strictly prohibited and may result in withheld or clawed-back commissions and termination:

  • Spam, unsolicited messaging, or misleading advertising of any kind.
  • Bidding on or using our trademarks, brand names, or confusingly similar terms in paid search or domains without our written permission.
  • Cookie stuffing, forced clicks, self-referrals, fake accounts, or any other fraudulent or artificial means of generating sign-ups or commissions.
  • Placing our brand alongside illegal content, content sexualising minors, hateful content, or content that breaches our Acceptable Use Policy or Blocked Content Policy.
  • Making representations or warranties on our behalf, or offering unauthorised discounts, rebates, or incentives.

4. Commissions and payment

  • Commissions are earned only on qualifying, completed, non-refunded subscriptions attributed to your valid tracking.
  • Commissions are reversed or clawed back for chargebacks, refunds, cancellations within any stated qualifying period, and fraudulent or policy-breaching activity.
  • Payments are made on the schedule, minimum-payout threshold, and method stated in your affiliate dashboard or agreement.
  • You are responsible for any taxes on your commissions and must provide any tax information we reasonably require.

5. Relationship of the parties

You are an independent contractor. Nothing in these Affiliate Terms creates an employment, partnership, agency, or joint-venture relationship. You have no authority to bind us or to make commitments on our behalf.

6. Intellectual property

We grant you a limited, non-exclusive, revocable licence to use our approved names, logos, and creative assets solely to promote Go Girlfriend under these Affiliate Terms. You must follow any brand guidelines we provide and stop using our assets immediately on termination. All goodwill in our brand belongs to us.

7. Term and termination

Either party may end your participation at any time, with or without cause, on notice. We may suspend or terminate immediately, and withhold or reverse commissions, where we reasonably believe you have breached these Affiliate Terms, our policies, or applicable law. Unpaid, validly earned commissions for compliant activity are payable on the next normal cycle following termination, subject to clawback rules.

8. Disclaimers and liability

The Program is provided "as is". To the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for lost commissions arising from tracking failures, customer refunds, or your own promotional choices. Nothing in these Affiliate Terms limits rights that cannot be excluded under applicable mandatory consumer-protection law.

9. Changes and governing law

We may update these Affiliate Terms or the Program on reasonable notice; continued participation means you accept the changes. These Affiliate Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles.
